You are right in one sense, Anna. I’m a marketing and communications major, and telemarketing IS legal. It is used to call and generate leads for companies who are in personal sales, along with other marketing companies.
However, the only time it is illegal is if the caller requests to be put on a “do not call” list and then receive a call from the same company.
As far as calling on cell phones, that is a bunch of BS if you ask me. They shouldn’t do it at all on ANY phone, but, as annoying as it sounds, that is someone’s job.

MemberWhen ever we see it’s a telemarketer…my husband answers the phone. He has a really deep voice and handles them in different ways. For A LONG time the MBNA company wouldn’t stop calling us…I’m talking….2-4 calls every DAY. He finally waited to the end arugued with some one and told them to take us off. That didn’t work…so he told another one to take us off…that didn’t work…so he told a THIRD one to take our number off and she said “FINE! But it’s going to take a MONTH” to which he replied “So, in a month you won’t call here any more?” She said “Yes…but it’s a month” He said “I DON’T CARE TAKE US OFF YOUR LIST!” Like waiting ONE MONTH was going to be a big deal and keep us from telling them to take us off the list!
As far as the cellphone list….not too many people have my number…if I get telecrap sales people there….I’ll put it on the list. Oh, and when I lived in PR…it took me FOUR months to get a landline number…my first EVER call I received?? A TELEMARKETER…in SPANISH! No language is safe! I really think that has gone WAY too far. I can’t imagine it’s a good way to sell things anymore.

ParticipantI honestly don’t mind them as long as they are real people. I know that they are doing this for a job — so I don’t be rude with them. I do get angry when the newspaper company phones and it’s a foreign worker who doesn’t speak English well, so you are battling over their handicap. I end up getting frustrated, and hang up.. but the worst is when they phone RIGHT back. Then my dad had to take care of it 😉
But I think the worse I ever experienced was the harassment from AOL. I signed up for their free trial, hated their service and cancelled. They would phone us literally every 3 days, and mail us CD’s once a week. My mom had to specially deal with that one 😉

MemberOne thing I hate about them is when they call during dinner, and when they pronounce our name horribly. I mean, its not another language name, it shouldnt be very hard…

ParticipantI’m horrid with them because I always end up sitting there and talking to them because I feel badly for them, having to talk to rude people all day and all this…ugh it’s horrid! So…yeah I end up chatting, but in the end I always tell them I’m not interested, but I let them go through their shpiel and answer their questions.

HAHAHA n8r I feel the same way! I was having trouble setting up my linksys router after coming home from school and losing the directions…but anyway, I was on the website, and I called them…got some foreign guy. I asked where I was calling and he replied “bangladesh.” nah, sorry, can’t deal with that. I just hung up. lol

KeymasterI used to be nice to them since I know they are doing their job, until they took advantage of that and decided to call 4-5 times a day. First I would let them talk all the way and I’d make them believe I was interested by asking loads of questions and then just interrupt and say “I’m not interested bye”. Apparently that didn’t work so now I have one of those airhorns ready for when they call. *mischievious grin*

Haha, I gotta try the airhorn thing. Sometimes when they call and ask for my parents, I just tell them that they aren’t available, and ask to take a message. They reply “No, I’ll call back later”. I’m so tempted to shout, “No don’t call back ever!” One time I asked for a telemarketers home phone number so my parents could call them back, that didn’t seem to work either.

Memberi have been on the do not call list from the time thay started it. it works good to stop alot of the calls but there is loop holes in it. a none profit organization can call and try to get you to donate money to them and bill collecters and it is legal. if you really wanna put a stop to those calls you can live with out, check and see if you phono company has privacy manager. I know sbc dose. with privacy manager if an automated device calls it intecepts the call and makes then state there name and if thay dont it hangs up on them and privacy manager shows up on the caller id. types of calls it intecepts – just about any type of call from a pay phone, calling card, collect calls, telemarketing, drunk friends that end up in jail for the night, pesky loan sharks and bill collecters.

MemberI know people who used to give them stories upon stories as to why their parents couldn’t come to the phone and why not to call back. Use your imagination. Give the telemarketer a laugh.

I’ve gotten past those. Easily.

MemberI was in Wal-Mart today and I got a telemarketing call on my cell phone. Normally, if the number shows up “Restricted” or “Unavailable” I don’t answer, but I had made a call to my roommate and thought she might have been calling me back. Now, that is annoying!
