ParticipantDo your research…
The kinds of works covered by copyright include: literary works such as novels, poems, plays, reference works, newspapers and computer programs; databases; films, musical compositions, and choreography; artistic works such as paintings, drawings, photographs and sculpture; architecture; and advertisements, maps and technical drawings.This is also taken from WIPO. Computer Programs = Software. You also don’t seem to understand what the word INTERNATIONAL means – look it up. BTW, which country do you reside in yeah right? I’m curious. {Edit: Yeah Right’s ISP is located in the U.S. hence he must reside in the U.S. as well}
…and yes I do know I don’t own my copy of Yahoo Messenger.
I’m sorry that your mission to create Yahoo! law abiding netizens is not working as smoothly as you had hoped, but as I said earlier progress will not be made through ignorance. Your quest against Y!Tunnel is not convincing the majority of us here.

…then you shalt be our savior. Forgive me if I don’t bow down before you just yet.
I have been in chat, and have never recieved a direct IM from Yahoo. But to be fair I will go into chat tonight and test your theory. Don’t worry I won’t break the Yahoo T.O.S. by using 3rd party software that I don’t own under copyright law in this country or any other unknown country that you may supposedly dwell in. Gee…I sure hope my account doesn’t get locked anyway.
btw..I am assuming you are making a direct connection before running an IP search, as otherwise every IM will come back as a Yahoo IP as all IM’s are routed through Yahoo’s servers.
August 18, 2003 at 11:51 pm #91841yeah right
Memberdo you remember the first time ytunnel came out it immediatly locked 30 percent of the accounts that tried to log in to it whats to say that wont happen again
August 18, 2003 at 11:59 pm #91842yeah right
Memberso if what your saying is all true about copy rights you better not quote me untill you know my legal name becasue taking my words in that manner does not give me full credit
August 19, 2003 at 12:14 am #91807shifter
ParticipantCopyright law does not necessarily cover conversations and discussions.
I will admit there are always grey areas concerning copyright issues, but unless your work can be considered completely creative and original it will most likely not be covered. Besides when you are quoted and your screen name is included, you are being given full credit (which is considered fair use). Yeah_Right is an alais, which means then that it is linked directly to your legal name through the forums registration process.

Memberaccording to you its anything written now make up your mind and this could be considered technical feed back and that is covered

MemberOk what is the point exactly here?? What are you arguing for??? Isnt this topic on Y!Tunnel??? I think the point YEAH RIGHT is trying to say that Y!Tunnel has no point because I mean yea it stops booting but booters are always coming up new programs for example currently Y!Tunnel Pro 220 is the newest version right, well when you go into booter web sites there are tons of programs to boot the 220. So what is the point exactly. You can either a the problem or the solution to the problem, theres no solution for this so why not be the problem!!!!

yeah right – It does not cover everything written and where exactly do you see technical feed back?
sweet-teen_chick – Yes this is starting to get a bit tedious. I apologize. I am simply trying to clear up some of yeah rights misguided points of views. As an admitted college student, I thought he may be able to grasp alternative points of view, but clearly I am mistaken. You do bring up a legitimate point as well regarding new boots, but the fact still remains that it will still hinder the amount of booting being committed. The only people being affected negatively by this program (besides the precious Yahoo T.O.S.) are booters. So forgive me if I fail to be convinced yet. Its like saying Antivirus programs are useless because programmers simply come up with new viruses.

Memberim not arguing laws the terms of service are just terms of service and yahoo owns all yahoo messenger program copies on every pc in the world its their software..so when some one uses a program thats works with messenger they are breaking the terms of service thats all and this can result in the the removal of an account im done with the rest of this ..that part is all that matters and people need to know it…….if people could own yahoo messenger then all of you would be right but no one can and thats the part your all missing//////////////////////////////////////////////////////////////////////////////////////////it does cover technical feed back wow now your the dence one that is there to cover everything in the work place and giving advice is part of its industrial………..i get a kick out of this these laws are so braod and cover so much its hard to fight over it and i was just messing with you about the quote take it a little easier the main point of this you agree with me on and so does jeff that people have the right to be warned thats all i wanted to do let it go lol
August 19, 2003 at 2:08 am #91805shifter
ParticipantOK, I think we have already agreed on this:
If you use Y!Tunnel you MAY be breaking Yahoo’s Terms of Service and your account MAY be locked as a result.
Fair enough? The debate still stands. I still wonder why you feel so strongly about this issue. It seems so pointless to me still. Yahoo is unlikely to lock your account for this reason, but if you want to be safe don’t use it. It comes down to a personal choice. Satisified?
August 19, 2003 at 3:26 am #91838yeah right
Memberyes i do\\\\ because if add space is lost this will a mute point yahoo chat will be gone

MemberQuote:quote:Originally posted by yeah rightjust one more thing the terms of service are fact not opinion and for any of you to say oh we just ignore that shows your intellegence level and when you advocate using programs that breach protocal your no better then booters but apparently breaking the rules one way is different then another hmmmmmm
How ironic is it when someone questions my intelligence when they can’t even spell the word intellegence? If your gonna argue you need to understand some of the basics to it. First off, you have to have a VALID POINT. Not like your gonna listen to anyone here, one thing for sure though, you need spellcheck. You are retarded.

MemberThank you shifter for pointing out the copyright stuff from him was incorrect. It’s almost the same for all countries. When you do write something , if its your own, you hold the rights. In a chat room or a forum or something, you would surrender these rights to who ever holds the server on which the stuff is based most likely. This is an issue affecting me recently, someone copied a huge chunk of one of my webpages and posted it in a chat room, a web master then took this chunk out of chat room and put on their website. They infringed copyright (the webmaster), not worth arguing over though.
Yahoo! WILL NEVER send you a normal IM. Never. If Yahoo! needed to get info accross to its users, they use those system messages. If they needed to get info to you personally, you would get an email from a @yahoo-inc.com e-mail address.
30% of accounts locked? This was not Y!Tunnel. I chat in the Yahoo! Chat Help rooms, and yes, huge amounts of people came in with their accounts locked, only a few of these used Y!Tunnel. At the time Yahoo! had changed stuff, you tried too many logins, account locked, if you used to many IDs at once, account locked, even doing some things in quick succession, like deleting/adding many buddys at once caused an account to be locked. The yahoo! changes just coincided with the release of Y!Tunnel. People still do come in with these locks, “account locked for security reasons”. This happens because the servers detected (correctly or incorrectly) a bot tried to crack an account. To stop the user gaining access, account gets locked. Its opened again going to a webpage, where one must verify they are human by reading and entering the word image.
MSN, Yahoo!, ICQ, and America Online are not affiliated with Trillian as far as I know, and its made clear at the bottom of the Trillian page, and in their disclaimer, that they are not affiliated with ICQ and America Online. This is probably because one of them owns the trademark to Instant Messenger. To infringe a trademark, would be to for Y!Tunnel to say on it, Yahoo! Messenger. It would be using Yahoo’s trademark to gain an unfair advantage in selling its product. It could also confuse the public into thinking Y!Tunnel was Yahoo! Messenger and therefore buying it. This information applies again to the UK trade marks act 1994. I would guess the USA one is similar, and if you wish to correct me, please read your act first. I don’t belive Y!Tunnel is using it inappropriately. I’m not a lawyer however.
When it comes down to it, its no bodies business what somebody else uses. If Yahoo! care, they simply close their account. The booters are starting petitions, and writing rubbish on their websites about chet, it dont take a brain to guess why. They get their kicks from writing booters and packing in trojans, people aint gonna get these if they know they wont work. IF chet wants to charge, thats his choice, if people want to pay, let them.
I have still to see anyone complain about my noads program, which does indeed prevent Yahoo! receiving payment.
You also say chet used to write boot programs, if so, there is no better person to know how to prevent them. Big companies emply known hackers to test and secure their systems. Virus companies may seek information from people known to produce viruses.

ParticipantIt’s amazing what you read now a days. Anyways. Onto the reason I am here. First of all let me introduce myself. I’m Peg. Oh yea some of you might know me and then again some of you might not. I am the one who started this petition that is going around. I guess I am more or less here to clear up a few things that disturbed me when I was reading this forum.
First of all.. I own NO illegal software, nor am I a booter, nor am I a programmer. So ask yourself this, Why would a person who claims to not be a booter start a petition to end Y!Tunnel that stops booters? LoL. First of all It doesn’t stop booters. It gives the people who brought it a false sense of security. I can’t sit here and say I didn’t buy it. I did. I used it. And once I figured out that I wasn’t safe, my computer was open to many targets I quickly dropped it like a bad habit. More or less I started this petition to 1. let people know that you are not safe, and there are other chat clients out there that are. 2. Y!Tunnel itself breaks alot of TOS agreements. Oh and let’s not forget the copyright! That’s a joke. 3.. Not only is he breaking Yahoo’s TOS agreement he’s breaking his own hosts TOS. Well the list is really endless of why I started this petition.
Now alot of people say that Chet started this Y!Tunnel on his own. Wrong.. He stole the idea and source from a very good friend of mine. But that’s neither here nor there.
So.. Mr. Freddy.. I do think i am quoting you on this when you said
Quote:quote:…”The booters are starting petitions, and writing rubbish on their websites about chet, it dont take a brain to guess why. They get their kicks from writing booters and packing in trojans, people aint gonna get these if they know they wont work.HAHA.. Like I said earlier I am not a booter, nor do I own a website. So I get no kicks out of writting rubbish on forums. I do however get a kick out of knowing that someone is talking about someone without knowing all the facts. Truly amazing. Needless to say.. Thank you for your time. Oh and btw don’t think for a second that the petition will go unnoticed. Something will be done. I am not the only one who feels this way.
:p Peg
